KCC 4039/2019
This case involved the eviction of a tenant. A key issue was notification of termination of the lease had not been done in the correct way.
Background
A leasing company filed a case against a tenant company before the court. The leasing company requested the court to order the tenant company to vacate the rented property and pay 60 dinars until the eviction was completed. The leasing company said that the tenant company had rented a shop in the central market for 400 Dinars per month for one year. The leasing company said that the tenancy agreement should automatically be renewed if no party gave notice otherwise two months before the termination of the agreement. The leasing company said that they had given notice to the company to vacate the property, but the latter had failed to do so.
The court ruled that the company should vacate the rented property. The court also ruled that the company should pay 60 Dinars starting from 15/10/2019 until the vacation of the property was complete.
Decision
The tenant company appealed the ruling before the court of appeal. The court upheld the appealed ruling.
