KCC 3798/2020
This case involved a request for an insurance company repay compensation paid to victims of a car accident by the claimants. Issues included a previous ruling and whether the car driver could claim from the insurance company when he was not insured with them but the car was.
Background
Two claimants filed a case against an insurance company before the court. They requested the court to order the company to pay the second claimant 100,000 Dinars. They said that the second claimant had caused the death of a person in a car accident. They stated that the second claimant was driving the first claimant's car. They mentioned that the car involved in the accident was insured by the insurance company. The claimants said that they had been ordered to pay the heirs of the victim compensation according to a previous ruling. The claimants also said that a criminal ruling had already been issued against the second claimant. They stated that they had the right to claim the compensation amount from the insurance company because the car was insured by it at the time of the accident.
