KCC 3559/2020

This case involved claims made by an insurance company for the repayment of compensation paid to heirs as a result of a road traffic accident. A key issue was whether the criminal ruling on the accident had become final or not.

Background

An insurance company filed a case against another insurance company before the court. The claimant company requested the defendant company to pay 25,288.461 Dinars. The claimant company said that two insured persons with the defendant company had been involved in a car accident and had caused the death of two individuals who were insured by them at the time of the accident. The claimant company stated that it had paid the compensation to their heirs according to a settlement reached between the two parties. The claimant company mentioned that it had received from the heirs a legal assignment to claim the value of compensation from the defendant insurance company. The claimant company said that it had requested the defendant company to pay the compensation value, but they had refused to do so.

The court ruled that the defendant company should pay the claimant company the amount.
