KCC 3437/2020
This was a case against the deputy minister of public works for compensation for damage to cars because of excessive rain. Isssues included whether this was a force majeure event and if a lack of maintenance of the sewage network, should be considered.
Background
Two claimants filed a case against the deputy minister of public works before the court. They requested the court to order him to pay 6,623 Dinars to the first claimant and 2,900 Dinars to the second one. They also requested the court to order the defendant to pay 350 Dinars to each of them as compensation. They said that rainwater had flooded their cars in the garage they owned and had completely damaged the cars. They stated that the deputy bore the responsibility for this damage due to the lack of maintenance of the sewage network. They mentioned that they had filed an urgent case in order to prove the status of the damage.
The court ruled that the defendant should pay the first defendant 6,873 Dinars and the second defendant 3,510 Dinars.
The defendant appealed the ruling before the court of appeal. The court dismissed the appealed ruling and the case altogether.
