KCC 3426/2019
This case involved a failure to pay agreed profits in the property sector. A key issue was whether the contract between the parties had an investment contract or a partnership agreement - and if they were operating as a joint venture.
Background
A claimant filed a case against two defendants before the court. He requested the court to appoint an expert in order to calculate the amounts of money they owed him and losses he had incurred as a result of his dealings with them. He said that he had agreed with the defendants on investing in real estate.
He said that the defendants were managing a property for him, but they failed to pay the profits.
The court ruled that the defendants should pay the claimant 39600 Dinars.
The defendants appealed the ruling before the court of appeal. The court dismissed the appealed ruling and the case altogether.
