This case involved the refusal of an insurance company to pay on an employee injury policy because they claimed the policy did not cover public holidays. The fact there were other related rulings said to be subject of an appeal was irrelevant.

Background

A company filed a case against an insurance company before the court. The company requested the court to order the insurance company to pay 5180 Dinars as compensation in addition to the legal interest of 7%. The company said that the insurance company had agreed to pay compensation for the company’s employee injuries during work according to Kuwait Law No. 6/2010. The company said that one of their employees had got injured during work and that they had requested the insurance company to pay him compensation according to the agreement signed between the two parties, but the latter had failed to do so.

The court ruled that the insurance company should pay the company 5180 Dinars.

The insurance company appealed the ruling before the court of appeal. The court dismissed the appeal and upheld the appealed ruling.
