KCC 3364/2020

This case involved compensation due to the mother of a man who had died in a car accident. A key issue was whether the mother should be paid this money when the boy's father was still alive and could provide for her.

Background

A claimant filed a case against an insurance company before the court. She requested the court to order the insurance company to pay her share of blood money in addition to 10000 Dinars as compensation for the death of her son. She said that her son had died in a car accident and that the car involved in the accident was insured by the company at the time. She also said that a criminal ruling had already been issued against the car driver who caused her son’s death. She said that this ruling had become a final one that could not be appealed.

The court ruled that the insurance company should pay the claimant 1666.6 Dinars for her share in the blood money. The court also ruled that the insurance company should pay the claimant compensation of 10000 Dinars for material and moral damages.
