KCC 3265/2019

This case involved a company which had illegally built worker's accommodation although its license had expired. Issues included if the license had expired and whether the case had been filed by an irrelevant party.

Background

A claimant filed a case against a defendant before the court. He requested the court to order the defendant to pay 65952 Dinars as compensation. He said that a criminal ruling had been issued against the defendant because he had built labour housing on public land although his licence had expired.

The court dismissed the case because it was filed by an irrelevant party.

The claimant appealed the ruling before the court of appeal. The court dismissed the appealed ruling and ruled that the defendant should pay the compensation.

The defendant appealed the ruling before the court of cassation. He said in his grounds of appeal that the ruling had erred in the application of law and had violated the right of defence.
