KCC 3220/2020

This case involved compensation payable by an insurance company for damage to a car. A key point was whether a criminal ruling against a driver was a final one as it had been in absentia and the driver had not been notified.

Background

A claimant filed a case against an insurance company before the court. He requested the court to order the company to pay him 6802 Dinars as material compensation in addition to 1000 Dinars as moral compensation. He said that his car was damaged in an accident and that the other car involved in the accident was insured by the company at the time. He said that a criminal ruling was issued against the car driver.

The court ruled that the insurance company should pay the claimant compensation of 2875 Dinars for material and moral damage.

The insurance company appealed the ruling before the court of appeal. The court dismissed the appeal and upheld the appealed ruling.
