KCC 3125/2019

The initial dispute involved a tenant who had been asked to pay rent and utility bills despite the landlord having forged the tenancy agreement. A key issue was the appeal deadline.

Background

A tenant filed a case against a landlord before the court. They requested the court to dismiss a previous ruling issued against them. They said that the ruling had ordered them to vacate the rented property and pay the outstanding rent of 8000 Dinars in addition to the utility bills of 3160 Dinars. They said that a criminal ruling had issued against the landlord because he had forged the tenancy agreement.

The court dismissed the case.

The tenant appealed the ruling before the court of appeal. The court dismissed the appealed ruling and dismissed the previous ruling issued against the tenant.

The landlord and the Public Prosecutor appealed the ruling before the court of cassation.
