KCC 2747/2020

This case involved two bounced cheques. The court had been wrong to dismiss a defence that these were guarantees for the opening of shops which had been prevented because of a government decision.

Background

A company filed a case against another company before the court. The company requested the court to order the other company to pay 8000 Dinars and legal interest. The company said that the other company had issued cheques, but they bounced. The company said that they had made a request to the court previously to obtain a payment order, but the request was declined.

The other company claimed that they had issued the cheques as guarantee for two agreements signed with the claimant company.

The court ruled that the defendant company should pay the claimant company 8000 Dinars and dismissed the request for interest.

The two companies appealed the ruling before the court of appeal. The court said that the appeal submitted by the claimant company was invalid. The court dismissed the appeal submitted by the defendant company and upheld the appealed ruling.
