KCC 2719/2020

This case involved a failure to transfer property as agreed to train horses. Issues included whether the contract was a customary one and if the rights and obligations related to this property had been transferred by the local council to the defendant requiring them to act.

Background

A claimant filed a case against a defendant before the court. He requested the court to order the defendant to cede a property without any related licence. He also requested the court exempt him temporarily from all annual subscriptions related to the property until he got it. He said that that the defendant had agreed to deliver the property to him to use to breed horses after he got the required licences. He said that he committed to his obligations according to the contract and paid 700 Dinars in advance and then he continued to pay the annual subscriptions until the end of 2018. He said that the defendant had failed to commit to his obligations according to the contract.

The court dismissed the case.
