KCC 26/2020

This case involved failure to pay the full amount due under a construction contract. Work had been paused due to damage of a neighbouring property but liability for this damage had nothing to do with this case and the work had been completed.

Background

A contracting company filed a case against a defendant before the court. The company requested the court to order the defendant to pay an amount of money and the legal interest. The company said that they had finished contracting works for the defendant, but they had failed to pay the full value of the contract.

The court appointed an expert in order to consider the case. The court then ruled that the defendant should pay the contracting company 11,537.5 Dinars.

The claimant and the contracting company appealed the ruling before the court of appeal. The court upheld the appealed ruling.
