KCC 2542/2020

This case involved whether a school had charged tuition fees which were above the maximum specified by the Ministry of Education.

Background

A claimant filed a case against some defendants before the court. He requested the court to order the defendants to pay him 869 Dinars in addition to 5001 Dinars as compensation for the moral and material damage. He said that he was a father of a student who studied at a school (the second defendant) and that the school had collected tuition fees which were much higher than the ones imposed by the Ministry of Education. He said that he requested the school to pay back the increase, but the school had refused to do so.

The court ruled that the defendants should pay the claimant 869 Dinars in addition to 500 Dinars as compensation for the material and moral damage.

The first defendant, who was the school owner, appealed the ruling before the court of appeal. The court dismissed the appeal and upheld the appealed ruling.

The Public Prosecutor requested the court to dismiss the appeal because it was invalid.
