KCC 2483/2020
This case involved unpaid commercial transactions. A key issue was the procedure for taking an oath.
Background
Two claimants filed a case against two defendants before the court. They requested the court to order the defendants to pay 390000 Dinars. They said that as a result of some commercial transactions, the defendants owed this amount. They said that the defendants had failed to pay the amount.
The court dismissed the case.
The claimants appealed the ruling before the court of appeal. The court dismissed the appeal and upheld the appealed ruling.
The claimants appealed the ruling before the court of cassation. They said in their grounds of appeal that the ruling had erred in the application of law and had insufficient evidence of causation. They said that they had requested the court to order the defendants to take the oath in order to prove their claims, but the court dismissed this request on the grounds that the requested oath was not accurate. They said that the oath they requested was accurate and they specified the amounts of money they want defendant to take the oath for.
