This case involved a failure of a company which had rented shop premises to spend a specified amount on advertising the mall where the shop was. The court had been wrong to ignore this evidence.

Background

A company filed a case against another company before the court. The company requested the court to order the other company to pay 61248 Dinars. The company said that the other company had rented several commercial shops. The company said that the contract signed between the two companies stipulated that the other company should pay 15% of the contract value for marketing campaigns but it had failed to commit to this clause in the contract.

The court dismissed the case.

The company appealed the ruling before the court of appeal. The court dismissed the appeal and upheld the appealed ruling.
