KCC 2310/2020

This case involved an eviction of a tenant for a failure to pay rent and utility payments. The lease contract could be terminated and the tenant evicted if one and not both parties had failed to meet the obligations.

Background

A landlord filed a case against a tenant before the court. The landlord requested the court to dismiss the investment contract signed between the two parties and to order the tenant to vacate the rented property. The landlord also requested the court to order the tenant to pay 4788 Dinars of arrears. The landlord also requested the court to order the tenant to pay 300 Dinars for the electricity bills and 433 Dinars per month for the rent from 01/10/2019 until the eviction. The landlord said that the tenant had rented the property for a monthly rent of 357 Dinars plus 57 Dinars for utilities. The landlord said that the two parties agreed that the tenant will pay the rent and utilities every three months. The landlord said that the tenant had failed to pay the rent on time and therefore owed the amounts.
