KCC 2302/2020

This case involved a request for compensation by airline passengers whose tickets had been cancelled twice under the Montreal Agreement. Flight delays were covered by that agreement but not ticket cancellations.

Background

Defendants filed a case against airlines before the court. They requested the court to order the airlines to pay 1744.6 Dinars for each one. They said that the airlines had cancelled their flight from Istanbul to Kuwait and they booked additional tickets, but the airlines cancelled these tickets as well. They said that they had been forced to wait in the airport for many hours until the Kuwaiti embassy in Turkey arranged new tickets for them. They said that the cancellation of the tickets caused them moral and material damages.

The court ruled that the airlines should pay the defendants 1500 Dinars for material compensation each in addition to 500 Dinars each for moral compensation.

The airlines appealed the ruling before the court of appeal. The court amended the appealed ruling and ruled that the airlines should pay the defendants 520 Dinars each.
