KCC 2291/2020
This case involved a compensation claim against an insurance company by an individual injured in a car accident. A key issue was whether the claim was premature as it was claimed the default criminal judgment was not yet final.
Background
A claimant filed a case against an insurance company before the court. She requested the court to order the company to pay 10000 Dinars as compensation. She said that she was injured in a car accident and that the car was insured by the company at the time. She said that a criminal ruling had already been issued against the car driver.
The court ruled that the insurance company should pay the claimant 4000 Dinars as compensation.
The claimant and the insurance company appealed the ruling before the court of appeal. The court dismissed the appeals and upheld the appealed ruling.
