KCC 1985/2016
This case involved additional amounts a bank had been deducting for a claimant's pension and severance pay for a loan despite the terms of a settlement agreement. The court had wrong ignored evidence provided by the claimant.
Background
A claimant filed a case against a bank before the court. He requested the court to appoint an expert in order to review all the loans he had received before the settlement agreement signed on 27/09/2011 and the amounts that had been deducted from his salaries. He requested the court to order the bank to pay the amount that the expert decided. He said that he had received a loan of 50000 Dinars from the bank and that the bank continued to deduct the instalments from his retirement salary illegally. He also said that the bank had also seized his severance pay although the two parties had agreed upon a settlement in this regard.
The court dismissed the case.
The claimant appealed the ruling before the court of appeal. The court dismissed the appeal and upheld the appealed ruling.
