Background
A landlord filed a case against a tenant before the court. They requested the court to dismiss the investment contract signed between the two parties and to evict the tenant from the rented property. They requested the court to order the tenant to pay 1200 Dinars and the rent until the eviction. They said that the tenant had rented a property from them in order to open a restaurant for a monthly rent of 1200 Dinars. The landlord said that the tenant agreed to pay the rent at the beginning of each month, otherwise the tenancy agreement would be void. The landlord said that the tenant had failed to pay the rent on time.
The court dismissed the case.
The landlord appealed the ruling before the court of appeal. The court dismissed the appeal and upheld the appealed ruling.
