KCC 1884/2020

This case involved compensation to a shop tenant who had failed to benefit from the premises because of building work there. A key issue was the fact the tenant had endorsed in the contract that building work could be carried out.

Background

A tenant filed a case against some defendants before the court. He requested the court to order the defendant to suspend the work they have done in the property he had rented. He also requested the court to order the defendants to demolish what had been built in the property. He also requested the court to order the defendants to pay 5001 Dinars as compensation for the moral and material damages that had resulted from the defendants’ failure to commit to their obligations according to the contract. He said that he had rented a shop from the first company, which assigned the management of the property to the second company which in turn assigned the management of the same property to a third company. He said that the three companies did building work in the place in a way that had caused a a lot of damage to his business.
