KCC 1873/2020

The original dispute involved eviction and a request for rent to be paid for a property it was claimed was not part of a waqf. Issues included the nullity of a case, notification of hearing dates and if government entities had to pay court fees.

Background

A claimant filed a case against a defendant before the court. He requested the court to order the defendant to vacate a disputed property and to validate his right to request the defendant to pay the rent and the compensation for damage. He said that the Ministry of Islamic Awqafs looked after the properties a deceased man granted for Islamic waqfs except the disputed property mentioned in this case. He said that the department of Islamic Awqafs had tried to resolve the dispute between the two parties and requested the defendant vacate the property, but he had refused to do so.

The court dismissed the case.

The claimant appealed the ruling before the court of appeal. The court dismissed the appeal and upheld the appealed ruling.
