KCC 1830/2020

This case involved a request for blood money following a work place injury because of a mistake made by an engineer. A key point was whether the main contractor was responsible to pay this, as the deceased had been working for a subcontractor as had the engineer.

Background

The heirs of a deceased man filed a case against two companies and a defendant before the court. They requested the court to order the defendant to pay the blood money of 10000 Dinars and compensation of 10000 Dinars for moral and material damages. They said that their father had died due to the mistake made by the last defendant who was working as an engineer in the location. They said that a criminal ruling was issued already against the engineer.

The court ruled that the defendants should pay the heirs the blood money of 10000 Dinars.

The first company and the engineer appealed the ruling before the court of appeal. The court dismissed the appeals and upheld the appealed ruling.
