KCC 1797/2020
This case involved a company which had rented roof space for advertising but had not benefited from it. There was still an advertising board belonging to another company on the roof. A key issue was whether a ruling in another case between the two defendants should be evidence in this case.
Background
A company filed a case against two defendants before the court. The company requested the court to order the defendant to let them benefit from the rented roof according to the tenancy agreement signed between the two parties. The company also requested the court to order the defendants to pay compensation of 5001 Dinars and a fine of 100 Dinar for each day of delay. The company said that they had rented the roof from the first defendant in order to use it for advertising purposes, but they had failed to use it because an advertisement board that belonged to the second defendant existed there.
