KCC 1758/2020
This case involved an usufruct agreement involving a hotel which had been sold on for an annual rent. It was claimed the rent was not paid. A key point was there was evidence of the contracts but not that the defendant had discharged their obligations. This had created damage which should be compensated.
Background
A company filed a case against a company before the court. The company requested the court to pay 12000 Dinars in addition to outstanding rent plus compensation of 6500 Dinars for material and moral damages. The company said that they had bought a usufruct agreement for a hotel from the other company. The company said that the two parties also agreed that the other company could benefit from the hotel and manage it for annual rent of 1000 Dinars. The company said they then sold the usufruct agreement to the other company for 10000 Dinars. The company said that the other company benefited from the hotel rent and failed to pay some of the rent to them.
