KCC 1753/2020

This case involved a request for payment of rent and eviction of a company which had not paid its rent. A claim that the tenancy agreement was forged was dismissed because the company license was at the same address and the general meeting had also been held there.

Background

A landlord filed a case against a company before the court. They requested the court to order the company to pay them outstanding rent of 30000 Dinars in addition to 3000 Dinars for rent for the period from the case initiation to eviction. The landlord said that the company had rented a shop from them for a monthly rent of 1000 Dinars. The company failed to commit to their obligations according to the tenancy agreement and did not pay the rent on time.

The company made an appeal against the tenancy agreement claiming that it was forged.

The court dismissed the company’s claim. The court ruled that the company should pay the landlord the amounts and vacate the rented property.

The company appealed the ruling before the court of appeal. The court dismissed the appeal and upheld the appealed ruling.
