KCC 1749/2020

This case involved a failure to pay for contracted internet services. A key issue was the evidential value of bills which were photocopies and not in Arabic. Some of the amounts on these bills had been paid which was considered an admission.

Background

A company filed a case against a defendant before the court. The company requested the court to order the defendant to pay an amount of money. The company said that the two parties had agreed on two contracts in which the company committed to provide internet services to the shop owned by the defendant. The company said that they had committed to their part of the contracts, but the defendant had failed to do so. The company provided the court with all the relevant documents that prover their claims.

The court ruled that the defendant should pay the company the money.

The defendant appealed the ruling before the court of appeal. The court dismissed the appeal and upheld the appealed ruling.
