KCC 1499/2020
This case involved a company's failure as a garnishee to provide the necessary information for a partner's debt to be enforced.
Background
A claimant filed a case against a company before the court. He requested the court to order the company to pay him amount of money. He said that he had lent the amount to one of the partners in the company. He said that a ruling had already issued against him and imposed a reservation on what he owned. He said that the company had failed to pay the amount and failed to reveal the partner’s share and to deposit the amount with the execution department as well. He said that the company therefore violated Article 218, 234, 237 of the Advocacy Law.
The court dismissed the case.
The claimant appealed the ruling before the court of appeal. The court dismissed the appeal and upheld the appealed ruling.
