KCC 1445/2019

This case involved the failure of a contractor to complete agreed work. Issues included the status of an expert report in a previous case as evidence. The claim the contract had been annulled because of a breach by the claimant for failing to notify the contractor the site was ready was also unfounded as the contract had done some work and the claimant had made some payments.

Background

A claimant filed a case against a contractor before the court. He requested the court to order the contractor to pay him 5992 Dinars. He said that the expert appointed by the court in a previous case had estimated that the contractor should pay this amount. He said that the contractor had agreed on finishing contracting work in his house and that he paid him 6000 Dinars out of 13000 Dinars. He said that the contractor failed to commit to his obligations according to the signed contract. He said that he had filed a case against the contractor and that the latter still owed the amount as a result.

The court ruled that the contractor should pay the claimant the amount.
