KCC 1394/2020
This case involved air passengers who had bought airline tickets from a travel agent and had been unable to use the return ticket because of a cancellation. A key issue was whether the travel agent was an agent by commission or by contract in deciding if the agent was liable.
Background
Two claimants filed a case against a company before the court. They requested the court to order the company to pay them 15000 Dinars as compensation in addition to the value of flight tickets. They said that they had booked flight tickets from Kuwait to Istanbul through the company which worked as an agent of the airline company. They said that when they tried to board the plane coming back from Istanbul to Kuwait, they were told that the flight was cancelled due to bad weather. They said that they were then told that the plane was full and that they could not board. They said that they were forced to buy new tickets to return home.
The court ruled that the company should pay the first claimant 1260 Dinars and the second one 420 Dinars.
