KCC 1149/2020
This case involved the validation of a property sales contract and compensation for breach. A key point was that in ruling the court could not ignore the additional obligation to provide a parking space as well as the property which was a contract term.
Background
A claimant filed a case against a company and the Department of Real Estate Registration before the court. He requested the court to validate a sales contract he had signed with the company. He also requested the court to order the department to register the contract and issue an ownership certificate for the flat he had bought from the company under his name. He also requested the court order the company to deliver the car park space he had bought along with the flat and pay 30000 Dinars as compensation. He said that he had bought a flat and car park space from the company and paid the agreed amount, but the company had failed to deliver the flat and parking space and had failed to register the contract and issue an ownership certificate.
The court ruled to validate the sale contract and ordered the company to pay the claimant 2000 Dinars as compensation.
