KCC 891/2018
This case involved which years an employee was entitled to obtain severance pay for.
Background
An employee filed a case against an employer before the court. He requested the court to order the employer to pay his financial entitlements in addition to compensation of 5000 Dinars. He said that he was working for the employer as a general manager and that he deserved severance pay but the employer had failed to pay it.
The court ruled that the employer should pay the employee 17956.9 Dinars and dismissed the request for compensation.
The employer appealed the ruling before the court of appeal. The court upheld the appealed ruling.
The employer appealed the ruling before the court of cassation. He said in his grounds of appeal that the ruling had erred in the application of law. He said that the employee deserved severance payment for the financial year 2006/2007 only according Kuwait Royal Decree No. 74/2007.
Decision
The court said that this argument was valid. The court said that the case documents revealed that the employee deserved severance payment for the financial year 2006/2007 only.
The court repealed the appealed ruling.
