KCC 878/2017

This case involved the severance pay due to an apprentice.

Background

An employee filed a case against a company before the court. He requested the court to order the company to pay him severance payment. He said that the company had failed to do so.

The court dismissed the case.

The employee appealed the ruling before the court of appeal. The court dismissed the appealed ruling and ruled that the company should pay the employee the severance payment.

The employee appealed the ruling before the court of cassation. He said in his grounds of appeal that the ruling had erred in the application of law and had insufficient evidence of causation. He said that the court had made a mistake by discounting the value of insurance in violation to Article 18 of Kuwait Law No. 6/2010 and failed to apply Article 51 of Kuwait Law No. 6/2010.
