KCC 55/2020

This case involved a claim by a retired employee who had previously received a social allowance which had stopped when she retired. A key point was whether the case was subject to the statute of limitations or she had filed it correctly.

Background

A retired employee filed a case against a company before the court. She requested the court to order the company to pay her social allowance. She said that she used to receive the allowance when she was employed but then the company had stopped paying the allowance once she retired.

The court dismissed the case.

The employee appealed the ruling before the court of appeal. The court upheld the appealed ruling.

Decision

The employee appealed the ruling before the court of cassation. She said in her grounds of appeal that the ruling had erred in the application of law. She said that the court had dismissed her case on the grounds of the limitation period though she had followed the proceedings stipulated by Article 107 of Kuwait Emiri Order No. 61/1976 .
