KCC 4/2020

This case involved whether the courts had a right to rule on a decision to remove an individual's Kuwaiti citizenship.

Background

A claimant filed a case against the prime minister and the minister of interior before the court. He requested the court to order the defendants to dismiss a decision by which his Kuwaiti citizenship had been dismissed.

The court ruled that the decision should be dismissed.

The defendants appealed the ruling before the court of appeal. The court upheld the appealed ruling.

The defendants appealed the ruling before the court of cassation. They said in their grounds of appeal that the ruling had erred in the application of law and had insufficient evidence of causation. They said that they had maintained before the court that the court did not have the jurisdiction to consider the case.

Decision

The court said that this argument is invalid. The court said that the claimant received the Kuwaiti citizenship according to Article . 21 of the Citizenship Law and that the dispute between the two parties was related to the application of the relevant laws and had nothing to do with the sovereignty issues as claimed by the defendants.
