KCC 369/2019

This case involved individuals accused of disposing of waste without a license. A key issue was the water which had been disposed of by one of the accused had been normal water not sewage so the crime did not exist.

Background

The office of public prosecution accused three defendants of disposing waste without a legal licence. The office requested the court to penalize the defendants according to the relevant laws.

The court ruled that the defendants should be imprisoned for three years and each of them should pay a fine of 20000 Dinars. The court ruled that the first and third defendants should be deported from Kuwait after the ruling execution.

The second defendant made an objection to the ruling. The court dismissed the objected ruling and acquitted the defendant. The first and third defendants made an objection to the ruling. The court upheld the ruling.

The office and the two defendants appealed the ruling before the court of appeal. The court dismissed the appealed ruling issued against the third defendant and acquitted him.
