Background

A claimant filed a case against two defendants before the court. He requested the court to order the defendants should pay 10500 Dinars. He said that he had bought a property from the second defendant but the first defendant had illegally seized it.

The court ruled that the defendants should pay the claimant 10500 Dinars.

The defendants appealed the ruling before the court of appeal. The court dismissed the appealed ruling and the case altogether.

The claimant appealed the ruling before the court of cassation.

The office of public prosecution said that the ruling should be repealed. The office said that the board of judges that considered the hearing was different from the one that had announced the ruling.
