KCC 187/2020

This case involved a ruling against people including a minister who had signed a contract which was not in the public interest. A key point was the ruling had not included the reasons it was based on.

Background

An investigation committee accused four people including a minister of signing a contract that had damaged public interests.

The court of appeal in the ministerial court suspended the consideration of the case and referred it to the constitutional court. The constitutional court dismissed the case.

The court ruled that the defendants should be imprisoned for seven years each. The court also ruled that the first three people should be dismissed from their positions. The court ruled that the fourth defendant should be deported after the execution of the penalty.

The investigation committee and the defendants appealed the ruling before the court of cassation.

Decision

The court dismissed an appeal made by the committee. The court said that the committee was an irrelevant party in the case and that only the office of the public prosecution could appeal the ruling.
