KCC 1762/2019
This case involved a refusal of a relative who had been temporarily to stay in a property to vacate it when requested and who claimed the property had been given to them. The relative lacked documentary evidence this was the case.
Background
A claimant filed a case against a defendant before the court. He requested the court to order the defendant to vacate his property. He said that the defendant was his relative and he had allowed to let him stay in his property temporarily. He said that the defendant, however, had refused to vacate the property.
The defendant filed a case against the claimant and another party before the court. He requested the court to validate his ownership of the property and prevent the claimant from taking any actions against him. He also requested the court to order the second defendant to issue an ownership deed to him.
The court dismissed the defendant’s case. The court ruled that the defendant should vacate the property.
The defendant appealed the ruling before the court of appeal. The court upheld the appealed ruling.
