KCC 799/2019
This case involved a public servant accused of receiving a bribe. Issues included the sentencing and the validity of the evidence.
Background
The office of public prosecution accused a defendant of receiving a bribe. The office requested the court penalise the defendant according the relevant laws.
The court ruled that the defendant should be imprisoned for five years and he should pay a fine of 300 Dinars. The court also ruled the defendant should be dismissed from his job as a public servant.
The defendant appealed the ruling before the court of appeal. The court amended the appealed ruling and dismissed the dismissal decision and upheld the ruling otherwise.
The defendant appealed the ruling before the court of cassation. He said in his grounds of appeal that the ruling had erred in the application of law and had insufficient evidence of causation. He said that the court had established the ruling on the grounds of the testimonies of two witnesses although they contradicted each other.
Decision
The court said that this argument was invalid. The court said that the court hadbeen satisfied with the evidence including the witnesses’ testimonies.
