KCC 639/2019

This case involved an editor accused of damaging a company's reputation in an article in a newspaper. A key point was what was said was considered acceptable criticism and had not intended to damage the company's reputation.

Background

The office of public prosecution accused a chief editor of a newspaper of publishing an article that included insulting expressions about a company. The office requested the court to penalize him according to the relevant laws.

The court ruled that the chief editor should pay a fine of 3000 Dinars.

The chief editor made an objection to the ruling. The court upheld the objected ruling.

The chief editor and the civil claimant appealed the ruling before the court of appeal. The court dismissed the civil claimant’s case. The court dismissed the appealed ruling and acquitted the chief editor.

The office of public prosecution appealed the ruling before the court of cassation. The office said in its grounds of appeal that the ruling had insufficient evidence of causation. The office said that the court had acquitted the chief editor on the grounds that the published article fell within acceptable criticism although the article had caused damage to the company’s reputation.
