KCC 54/2020
This case involved the validity of the investigation procedures for individuals charged with firearms offences.
Background
The office of the public prosecution accused two people of possessing firearms without a licence.
The court acquitted the second persons and ruled that the first person should be imprisoned for five years.
The convicted person and the office of the public prosecution appealed the ruling before the court of appeal. The court dismissed the appeals and upheld the appealed ruling.
The convicted person appealed the ruling before the court of cassation. He said in his grounds of appeal that the ruling had violated the right of defence. He said that he had maintained before the court that the investigation procedures were invalid but the court dismissed his appeal.
Decision
The court said that this argument is valid. The court said that the ruling violated Article No. 78 and 85 of Kuwait Law No. 17/1960 . The court said that the case documents revealed that the investigation procedures were invalid.
The court repealed the appealed ruling.
