KCC 414/2020
This case involved an individual acting aggressively to a neighbouring country and committing cybercrimes. The court of appeal had acquitted him without the ruling following the evidence.
Background
The office of the public prosecution accused a person of undertaking aggressive action against a neighbouring country, publishing tweets against Saudi Arabia and misusing of communications medium.
The court acquitted the person of committing the first crime. The court ruled that the accused person should be imprisonment for one year and pay a guarantee of 1000 Dinars. The court suspended the implementation of the ruling until a final ruling was issued in the last two crimes.
The convicted person and the office of public prosecution appealed the ruling before the court of appeal. The court upheld the appealed ruling.
Decision
The court said that the ruling issued by the court of appeal had been contradictory. The court said that the court of appeal had clarified the evidence upon which it convicted the person and then acquitted him of the first crime. The court said that they had failed to understand the grounds upon which the court of appeal had established its ruling.
The court repealed the appealed ruling.
