KCC 363/2016

This case involved compensation for insults on social media which had damaged a business. The compensation ruled had been reduced without suitable grounds.

Background

A victim filed a case against a defendant before the court. He requested the court to order the defendant to pay him temporary compensation of 5001 Dinars. He said that the defendant had insulting him by using social media and that a criminal ruling had already been issued against him.

The court ruled that the defendant should pay the victim 2000 Dinars as a compensation.

The victim and the defendant appealed the ruling before the court of appeal. The court amended the appealed ruling and ruled that the defendant should pay the victim compensation of 300 Dinars.

The victim appealed the ruling before the court of cassation. He said in his grounds of appeal that the ruling had erred in the application of law and had insufficient evidence of causation. He said that the compensation the court had ordered the defendant to pay did not compensate the damage which had resulted. He said that the damage caused by the defendant had badly affected his reputation in a way that hurt his business.
