KCC 280/2020

This case involved a bounced cheque, and whether the appeal documentation was valid and signed by a certified lawyer.

Background

A claimant filed a case against a company before the court. He requested the court to order the company to pay him 1,000 Dinars. He said that the company owed the amount as a result of a bounced cheque.

The court ruled that the company should pay the amount.

The company appealed the ruling before the court of appeal. The court dismissed the appeal document because it was invalid.

The company appealed the ruling before the court of cassation. The company said in its grounds of appeal that the ruling had erred in the application of law. The company said that the court had dismissed the appeal document on the grounds that it was not signed by a certified lawyer before the court of appeal, although the lawyer was registered with the constitutional court and the court of cassation.
