Background
A claimant filed a case against the Ministry of Public Works before the court. He requested the court to pay him compensation of 17300 Dinars. He said that his personal documents which had been in his case were damaged due to a flood.
The court ruled that the Ministry of Public Works should pay the claimant compensation of 16000 Dinars.
The ministry appealed the ruling before the court of appeal. The court dismissed the appealed ruling and the case.
The claimant appealed the ruling before the court of cassation. He said in his grounds of appeal that the ruling had erred in the application of law and had insufficient evidence of causation. He said that the ministry had not taken precautionary measures against the flood and had failed to inform the public of the consequences of the flood.
