KCC 747/2018

This case involved if there was evidence a Minister had been insulted on a TV programme.

Background

The office of public prosecution accused three defendants of insulting the Minister of Justice via a TV show. The office requested the court to penalize the defendants according to the relevant laws.

The court ruled that each defendant should pay a fine of 3000 Dinars.

The defendants appealed the ruling before the court of appeal. The court amended the appealed ruling and ruled that the first defendant should pay a fine of 1500 Dinars and upheld the appealed ruling otherwise.

The defendants appealed the ruling before the court of cassation. They said in their grounds of appeal that the ruling has erred in the application of law. They said that the legal element of the crime had not been existed in their case.

Decision

The court said that this argument was invalid. The court said that the court considered all aspects of the case properly and established the ruling on the grounds of solid evidence including the recording of the TV show in which the Minister of Justice was insulted.

The court dismissed the appeal and upheld the appealed ruling.
