KCC 678/2019

This case involved the eligibility of an individual to run for election.

Background

A claimant filed a case against two defendants before the court. He requested the court to order the defendants to dismiss a ministerial decision by which he had been deprived of running for election. He said that he had already met all the legal requirements for running for election.

The defendants appealed the ruling before the court of cassation. They said in their grounds of appeal that the ruling had erred in the application of law. They said that the claimant had committed actions that harmed his reputation and therefore he was not eligible to run for election.

Decision

The court said that this argument was invalid. The court said that the relevant commission and the court had concluded that the actions committed by the claimant should not make him ineligible of running for election.

The court dismissed the appeal and upheld the appealed ruling.
