KCC 50/2018

This case involved sentencing of two individual accused of possession and trade in drugs. As investigations and proceedings had been very rapid the court was not convinced the case was based on solid evidence.

Background

The office of public prosecution accused two defendants of possessing drugs in order to take and trade. The office requested the court to penalize the defendants according to the relevant laws.

The court issued life sentences against the defendants. The court also ruled that the defendants should pay a fine of 10000 Dinars each. The court also ruled that the defendants should be deported from Kuwait after the execution of the punishment.

The defendants appealed the ruling before the court of appeal. The court dismissed the appealed ruling and acquitted the defendants.

The office of public prosecution appealed the ruling before the court of cassation. The office said in its grounds of appeal that the court had erred in the application of law and had insufficient evidence of causation. The office said that the court had acquitted the defendants and dismissed the police investigations and the testimonies of police officers who arrested the defendants.
